The International Trade Commission (ITC) has issued a press release stating that on December 14, 2006, a majority of the six Commissioners voted to revoke 21 antidumping (AD) and countervailing (CV) duty orders on certain carbon steel products, including carbon steel plate from Taiwan, corrosion-resistant carbon steel flat products from various countries1, and cut-to-length carbon steel plate from various countries2.

 

According to the press release, the ITC Commissioners determined that the existing AD and/or CV duty orders on imports of carbon steel plate from Belgium, Brazil, Finland, Germany, Mexico, Poland, Romania, Spain, Sweden, Taiwan, and the United Kingdom3 and the orders on corrosion-resistant carbon steel flat products from Australia, Canada, France, and Japan will be revoked.

 

However, the ITC Commissioners also determined that the existing AD duty orders on imports of corrosion-resistant carbon steel flat products from Germany and Korea4 will remain in place.

 

(This action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act (URAA), which according to 19 CFR 351.218(a), requires the International Trade Administration (ITA) to revoke an AD or CV duty order, or terminate a suspension agreement, after five years unless the ITA and the ITC determine that revocation would be likely to lead to both (1) a continuation or recurrence of dumping or a countervailable subsidy and (2) material injury to a U.S. industry within a reasonably foreseeable time.

 

A negative determination either by the ITA with respect to (1) above or by the ITC with respect to (2) above results in the revocation of the AD and/or CV duty order.)

BP Note

 

Nine countries which are currently subject to AD and/or CV duty orders on carbon steel plate are not affected by this set of five-year sunset determinations.
