The International Trade
Administration (ITA) has conducted an administrative review of the antidumping
(AD) suspension agreement on certain cut-to-length carbon steel plate from
Ukraine for the period November 1, 2004 through October 31, 2005.
(The ITA previously stated that
it signed an agreement with the Government of Ukraine (GOU) in 1997, which
suspended the AD duty investigation on subject merchandise (the suspension
agreement).
The ITA stated that it primarily
relies upon three tools to administer the suspension agreement: i) export
licenses issued by the GOU, and received by the ITA from U.S. Customs and
Border Protection (CBP); ii) reference prices, revised quarterly by the
Commerce Department, and iii) the annual export limits setting a quota on total
imports of subject merchandise from Ukraine.)
The ITA states that its review of the information submitted by the GOU
indicates that each of the export licenses governed by the suspension agreement
were at or above the quarterly prices stipulated by the agreement.
Furthermore, the ITA states that data supplied by the GOU in its
monthly reports, as well as the ITA's independent review of import data
compiled by CBP, indicate that the GOU did not exceed its annual export limits.
Therefore, the ITA has determined that the GOU is in compliance with
the suspension agreement. As a result, the ITA will continue to suspend the AD
investigation on subject merchandise, and no AD duty order will be applied.
