Nigeria is Eligible for AGOA Duty-Free Treatment

for Certain Handloomed or Handmade

Fabrics/Articles, Certain Folklore Articles,

and Certain Ethnic Printed Fabrics

 

 

 

The Committee for the Implementation of Textile Agreements (CITA) has issued a notice stating that, effective August 1, 2005, certain textile and apparel goods from Nigeria are eligible for duty-free treatment under the “handloomed, handmade, folklore articles, or ethnic printed fabrics” provision of the African Growth and Opportunity Act (AGOA).

 

Eligible Articles Must Be Produced in and Exported from Nigeria

 

CITA states that it has consulted with Nigerian authorities and has determined that the following items are eligible for duty-free treatment under AGOA if produced in and exported from Nigeria:

 

·      Hand-loomed or handmade – hand-loomed fabrics, hand-loomed articles (e.g., hand-loomed rugs, scarves, place mats, and tablecloths), and handmade articles made from hand-loomed fabrics;

 

·      Folklore – approximately 20 folklore articles described in Annex A to CITA’s notice (Kaftan, Senegalese, Buba and Sokoto, Kenbe, Dansiki, Gbariye, Isiagu or Chieftaincy, Agbada, Booboo, Buba and Iro, Yar Jos, Baban Riga, Jamfa, Yarshara, Dandogo, Abaya, Kaftan Falmara, Zabuni, Kufta, and Falmara).  See Annex A for folklore article requirements (e.g., no modern features such as zippers, patterns must be traditional or historical to Nigeria, etc); and

 

·      Ethnic printed – ethnic printed fabrics that meet the criteria listed in Annex B to CITA’s notice.  See Annex B for ethnic printed fabric criteria (e.g., selvedge on both edges; the fabric is classifiable in HTS 5208.52.30 or 5208.32.40; the fabric must be manufactured by one of the 11 listed companies; etc.).

 

(CITA explains that AGOA provides duty-free treatment for imports of certain hand-loomed, handmade, folklore articles or ethnic printed fabrics that are certified as such by the competent authority in the beneficiary country.  CITA notes that the AGOA Acceleration Act of 2004 (AGOA III) added ethnic printed fabrics to that list.  In addition,  CITA states that Executive Order (EO) 13191 (dated 01/17/01) and Presidential Proclamation 7912 (dated 06/29/05) authorize CITA to consult with listed beneficiary countries and to determine which, if any, particular textile and apparel goods shall be treated as being hand-loomed, handmade, folklore articles, or ethnic printed fabrics.
