New Set of Amendments to the

 Harmonized System of Explanatory Notes

(Part XI)

 

 

 

The World Customs Organization (WCO) has issued an amending supplement (No. 5, dated February 2004) to the Harmonized System (HS) Explanatory Notes (ENs).  (Although not binding by U.S. Customs and Border Protection (CBP), the ENs are followed by CBP whenever possible.)

 

(This is Part XI of a multi-part series of summaries on this amending supplement.  See future issues of ITT for additional summaries.)

 

The following are short summaries of the amendments made to the ENs by this latest amending supplement:

 

1.      Weaving Machines (Looms) in HS 84.46

 

On page 1517, the second to last sentence in the final paragraph has been amended by adding a "." after the word "yarns."  In addition, the parenthetical phrase "(circular box motions, drop box motions, etc.)" has been deleted.

 

2.      Knitting Machines, Stitch-Bonding Machines, and Machines for Making Gimped Yarn, Etc. in HS 84.47

 

On page 1519, the two main groups listed under heading "(A) Knitting Machines" have been reversed so that "Circular machines" is now item (1) and "Flat machines" is now item (2).  The text of both paragraphs remains unchanged.

 

Also on page 1519, under heading "(C) Machines for Making Knotted Net, Tulle, Lace, Braid, or Trimmings, for Gimping Yarns, for Embroidery, for Tufting, Etc." the list of items included has been amended by: (1) removing the phrase "(e.g. Roller machines)" from item (2); and (2) removing the phrase "(e.g., Levers machines and Nottingham lace machines)" from item (3).

 

On page 1520, item "(5) Embroidery machines" has been amended to read: "Embroidery machines, including hand embroidery machines (embroidery machines with pantograph shuttles), which, by means of needles, embroider various designs with one or more threads on an existing ground of woven fabric or other material.  Embroidery machines, other than manually operated, may be equipped with Jacquard or similar mechanisms.  The heading also covers thread drawing machines which withdraw, and bind the remaining threads into open-work embroidery."

 

(Previously, this paragraph read: "Embroidery machines which, by means of needles, embroider various designs with one or more threads on an existing ground of woven fabric or other material; these machines may be equipped with Jacquard or similar mechanisms.  The heading also covers thread drawing machines which withdraw, and bind the remaining threads into open-work embroidery.")

 

3.      Auxiliary Machinery for Use with Machines of Heading 84.44, 84,45, 84.46 or 84.47, Etc.  in HS 84.48

 

On page 1522, the list of items included under "(A) Auxiliary Machinery" has been amended by removing items "(5) Jacquard card punching machines" and "(7) Shuttle changing mechanisms."  As a result, items (6) through (23) are now reordered as items (5) through (21).

 

On page 1524, under "(B) Parts and Accessories," the list of items included has been revised as follows:  item "(13) Metallic healds" has been revised to read "Metallic healds, either flat or as lengths of two twisted wires, with a control eye through which the wrap yarn passes, and metallic harness cords which connect heald frames to the lifting mechanism."

 

(Item (13) previously read: "Metallic healds, lengths of wire with a control eye through which the warp yarn passes, and metallic harness cords which connect heald frames to the lifting mechanism.") 

 

On page 1525, the list of items excluded from HS 84.48 has been revised as follows:  Item "(a) Perforated cards of paper or paperboard for Jacquard or similar machines (heading 48.23)" has been deleted.  As a result, items (b) through (d) have been reordered as items (a) through (c). 

 

In addition, a new item (d) has been added which reads: "Recorded media for controlling Jacquard or similar machines (heading 85.24)."
